Moore files civil suit...

He should win and for good reason. You can say that he's a differnet player now, but he never payed for ending someones career, and don't tell me 13 games and the playoffs are enough for making someone learn to walk and stand again.

Interesting timing seeing how team Canada just played it's first game in Torino.

I wonder which story will get more air time -- operation Slap Shot or the Bertuzzi assault on Moore.

Did Moore have to relearn how to walk? I don't remember that.

Moore should win but I'm not familiar with Canadian law so I may be wrong.

The amounts he is asking for don't seem too out of line really. His hockey career was effectively ended. Even if he was a career 3rd liner, 15 million for a career of lost wages seems like a very realistic amount.

The only part I have a problem with is his parents are asking for 1.5 mil. WTF???

I think Bert ought to settle this out of court and just pay the man what he is asking. Intentional or not he hurt the man. He has the opportunity to make things right. If he does, he can honestly say "I did a bad thing, I've accepted my punishment, it's time for forgiveness."

I'd have no problem cheering for him at that point.

I will bet every last dollar that I own that Bertuzzi will not settle for even a quarter of what he is being sued for. He says he's sorry, but words are cheap and when it comes down to dollars and cents and actions of significance, well, we'll see. Moore should have done this when Bertuzzi's status was still up in the air, both in the NHL and in the Olympics, and Moore had a little more leverage.

B] He's suing in Ontario when the Colorado judge suggested he shoud do it in Vancouver.

c] He's a below average hockey player at best. "Average" NHL salary at 1 million, "average" career at 5 years. Doesn't add up to 15 million.

d] Why do his parents need money?

I think Bert's served his time. Someone mentioned "don't tell me 13 games and the playoffs are enough for making someone learn to walk and stand again". But here's why I disagree.

Nobody has proved it was Bert that broke his neck. Whether it was the punch of him getting jumped on afterwards. 13 games, no big deal, but he also cost Vancouver a shot at the cup. They lost to Calgary in game 7OT, who eventually lost in game 7 of the cup finals. Bert's a difference maker and could have very likely altered that series. Say they go to the finals, that's roughly 20-25 games. General rule of thumb is 1 playoff game = 2 regular season games. Toss in the international events he's lost and you basically have a full season lost because of this.

A. I agree unless there is a deadline he had to meet in order to file the suit.

B. Both are Ontario residents and there's no way he gets a fair shake in BC.

C. No court ever gives you more than you ask for, always aim higher than you think you'll get.

D. The only thing I can think of is to cover travel expenses, lost wages, etc... to go see him when he was in the hospital and recovering. As for the amount, see above.

Bert caused the situation. He is responsible for the altercation that resulted in Moore ending up with a broken neck. Therefore he has some liability, the amount is up to the courts.

International events are irrelevant to NHL suspensions, or at least have been in the past. The only reason he was reinstated is because the NHL wanted to make sure that people came back to games and if Vancouver tanked without Bert, attendance would have been down.

Moore is probably asking for $15 million, but not expecting to receive that amount. If you want $10 million, ask for $15 million and then settle for $10 million. But I agree that $15 million for his career is too much. I'm not sure how his parents are able to sue. Moore was the only one hurt, and isn't a minor so I'm not sure how his parents can be involved in the lawsuit.

$15 mill is about triple what he would have made in his entire hockey career. That's a little more than "overshooting" the goal to bump it up IMO. He said in one of his court apperances that he doesn't consider himself a native of Ontario anymore, so it's another reason against having it here.

The IIHF and NHL suspensions don't work together, but the Canadian Media would've went nuts if he had went to play. It's the same philosophy he is using against the broken neck. Although there isn't concrete evidence that he caused it, the altercation was clearly a situation Bert caused. As for the picking, there's no way to prove Bert wasn't on the team because of his suspension, but it's pretty obvious.

I really don't mind him suing, I just think it's garbage he picks the olympics, determines to go to Ontario and overshoots his own worth by so much. Then his parent's sue? I would've thought the "Expenses" would be covered under the $2 million they are also suing for.

He's never going to get another job in hockey so he can kiss away potential scouting, management or broadcasting jobs as well as just playing. I agree with you about the timing, the other stuff is for a court to decide and that's where they're going.

As I recall watching the video of his "assault" on Moore, I don't remember there being much fight left in him when his lifeless body hit the ice. But you're right, maybe it wasn't the punch that broke his neck, maybe it could have been the moment he shoved him headfirst into the ice while falling on him. But then again I'm no doctor, but i know an attack when i see one, I just can't justify defending something like that, or forget it, for that matter. It's sad that his carrer is "tainted" for this, but the fact is, someone will always mention this incident regardless of what happens next. And I can't justify 13 games, playoffs, a locked out season, and international affairs as suitable punishment. The only time hockey fans weren't arguing about this was when the rink went silent and moore was carried off on a stretcher, after that it was all about where your loyalties as a fan laid. There'll always be two sides separating hockey fans on this issue.

personally i would have loved to see how moores condition would be had the extra what, like 600 pounds landed right on top of him causing his neck to snap each time someone jumped on bert. The sad part is, one of the Avs players tried to hit bertuzzi and ended up hitting Moore. This whole Moore-Bertuzzi garbage is getting out of hand.. Come on, even Sakic said 'that's enough'.

So in agreement with Mr Sakic's words, THATS ENOUGH!

it should've of all happend when this was a hot debate, throwing it out on the dawn of the mens olympics, is an excuse for attention. I know Moore deserves to reimbursed whatever amount he is owed by bertuzzi's action, but why now. Could've been done years ago and they wait til now...... its the olympics for christ sake, the past is done. Shouldve at least waited after or way before but not now.

besides my rant, im all for moore milking bertuzzi's salary

It doesn't matter exactly when the damage occured. If the initial attack had not been commited, the events in the next few seconds would not have happened and no damage would have occured and we wouldn't be having this discussion. Claiming he is not responsible is like me pushing you in front of a moving bus and then claiming I didn't kill you the bus did. It is still my fault even though the bus did the damage.

Getting back on track, 15 million is very fair. There isn't a single person in the world who can say what Moore would have made in his career. Saying that 15 million is triple what he would have made is pure speculation.

We have no way of knowing if he would have improved as a player. We have no way of knowing how long his career would have lasted. He could have grown into a player worth 2 mil a year or more. Or, he could have been AHL bound the next season. We just don't know what the future could have held for him. So saying he would never make 15 million playing hockey is absolutely unfair.

I am glad to see people addressing the legal issues, rather reviving the initial arguments. I think the only people who win in these situations are the lawyers.

First of all (given the nature of the lawsuit)..he had to wait just to be sure that he could not have recovered enough to play again.

Second the choice of the location of the suit and the timing were no doubt selected by the attorney's from legal necessity and/or for the best possible results. It is quite possible that the precedences set in Ontario are more favorable to a positive judgement than other locations...Or...The location of the filing may simply be because of a legal "place of residence" determination given the travel history of most hockey players over their carreer. If there is some bitterness on his part driving the timing...I think it might be understandable, although not laudible.

I hope Steve Moore takes Bertuzzi for every penny that he's worth.

Amen to that!

The law suit has obviously been planned to give Moore the best chance of winning, and to get the most media attention possible.

For the same reason Michael Jackson's trial was so well broadcasted, because if it wasn't he would have gone down, simple as.

To tell the truth i hope Steve Moore win's, if not only for him but to show that you just can't do stuff like that.

Whether or not he would have ever earned that much is not the only consideration in terms of how much compensation he is due. We also have to look at things like pain and suffering - any medical bills that are not covered. The incident changed his life, in part. That is were the extra dollar amount (over and above his salary losses) comes from.

And like Chadd said, plaintiffs ALWAYS ask for more than they expect to get.

$15 million is for lost wages, $2 mill is the pain, suffering, etc. I believe the $1.5 for his parents are the same.

I cannot say for sure he wouldn't have turned into Gretzky, but we cannot say for sure he wouldn't have turned into Lonny Bohonos either. You find a middle ground and go with it. He was a below average NHLer when he was hurt, he was too old to be considered a prospect and should've been "just coming into his prime". I overestimated lost wages with $5 million, so I think that's VERY fair.

They say he had a 2 year deadline to make this announcement and it was coming close to expiring. I believe he can still come back and play in the NHL if he is able to do so. I have heard he was still trying.

i don't know why people are not picking this guy up.. sure he's washed up but he has other things going for him like bert not being able to play in any games he plays in. If i was the oilers i would pick this guy up and give him a two way contract.. send him to the minors and bring him up when they play the canucks. just think about how much he would be worth if your team had him in the lineup and playing the canucks in the playoffs and don't forget a team like the oilers have to play them 8 times a year! :lol:
