Scammed by Kijiji

Hey everyone,

I thought I'd get everyones thoughts on what I should do about being scammed on Kijiji. I'm not sure if there is a specific process or a way that tends to work more often than not. I'd appreciated any input I can get because I just can't get over the fact that I may have given away a whole entire set of goalie gear for free. Thanks in advance!

You should have the guy's contact information or at least what he provided to you. Call the cops in his area and see what they'll do for you. Or email him and threaten legal action.

I had to do this with a kid I purchased a stick from (not on this forum). He responded quickly.

This sounds like a dumb question, but if he is in a different city, do I just dial 911 anyway and request something?

I would google his city's police department. They should have a non-emergency number you can call. Dialing 911 wouldn't accomplish anything.

I'm missing something. Did you not confirm payment before handing over the goods? Did you meet them or shipped it to them?

It was a trade...my set for his set, so I shipped it to him right away because thats what he said he'd do for me. I feel like i shouldve known better because four weeks later, my stuff still isn't here.

Call the cops on him. You have his home/work address as you have shipped your gear to him already.

Not to be a prick but may that be a lesson learned, the hard way but still, I hope you will learn from this. On Kijiji, on every single item for sale there is a safety information box that strongly advise you to meet the seller in person in order to avoid fraud of the sort. It's never a good idea to trust anyone unless you have some info that says otherwise ie: the good/bad sellers list on MSH for exemple, an Ebay profile with good feedback etc. and even then it's not foul proof, specially on Ebay as we've seen that some people end up with 100% feed back even though they have screwed people over in the past. At least, you've got some sort of protection with Paypal.

I know that as a kid I was always told there is no such thing as a stupid question. This might take the cake.

Anyhow, when was the last time you heard from him? If he is scamming you, I bet the address you sent the stuff to was not his home. Post pics of your stuff and tell us what area you sent your gear to. Goalie gear would be obvious to spot. Keep an eye on ebay also, that shit could be heading overseas.

i've been scammed twice......the cops wouldnt do anything for me in my case...there a few internet fraud website that have forms you can fill out......you have zero protection with paypal unless the sale was made thru ebay....

that's what I was saying. Actually, it's not entirely true come to think of it. I believe that you have some sort of protection under Paypal no matter where you made the purchase as long as you paid using Paypal. It's Paypal offering the protection, not Ebay.

It is irrelevant in this case though as it was a trade.

Cops wont do anything. It isnt theft because you gave him the stuff. You will have to go to civil court. Even if you did go to the cops, you would need a butt load of evidence supporting you. emails and what-not.

But like I said, you willingly gave it to him. Civil court.

You may not find cops who are willing to handle this case, and claim "It's a civil matter", but make no mistake, it's a crime.

The basic elements of theft are, in the old jargon, a "taking and carrying away with the intent to permanently deprive the owner" of his property. You'd want to look at the relevant theft and criminal fraud statutes to determine the precise provisions that were violated. Additionally, the use of the internet may very well involve use of electronics/wires somewhere along the line that bring this crime within the broadly written mail fraud statutes, as well as some internet fraud provisions.

The property was not "given", it was sent in exchange for something else, which was not sent in turn. That's stealing, and it's illegal.

To the OP, is the scammer located in the same country as you? If not you are pretty much screwed as to legal action you can take. As soon as I saw this I immediately thought it was a Nigerian scam. I hope I'm wrong.

I think you are misreading me or just don't understand what I wrote... I'm not telling him to put a claim through Paypal like you seem to think.

Wrong. I dont know what your background is with conducting investigations and laying charges on people is but, I am going to have to disagree. We get cases like this all the time and they go nowhere. He knowingly sent his items to the other person. No theft was involved. He didnt take the steps needed to make sure he got his payment. this is 100% a civil matter. If you read the CC the term "take" comes up repeatedly. This person did not "take" anything. If we use common sense did this guy steal? Yes, but unfortunatly the justice system doesnt have a pinch of common sense in it.

He MAY have a case for false pretences however; this would be a long process and like i said earlier, you would need lots of e-mails stating your agreements and everything.

If you have e-mails documenting the proposed trade...would that be considered a binding agreement? Could you have a breach of contract, maybe?

As for the title of this thread:

"Scammed ON Kijiji" is probably better. Kijiji itself is not at fault. Just sayin'

BTW, are you dealing with Canadian law? Your spelling of "pretences" indicates you're not in the U.S. I am, and my opinions are regarding U.S. law. That may account, at least in part, for our differences. I assumed this was a U.S. case; if it was stated otherwise, I missed it.

I was under the impresison that kijiji was a canadian site only, so I assumed it was a canadian issue. I could be wrong as well though.
