I think Marcelo makes valid points regarding the attitude of a business towards its products. Every product that goes out the door tells the customer something. A business has to decide what it wants that product to say to the customer. Obviously, each customer decides how important the appearance of the product is to him, and what that appearance implies, and leads him to infer from it. Regardless of how some customers may look at it, it's not unreasonable to think that a business owner should take pride in the apparent details of his product, and to believe that these show something about the company's attitude toward manufacturing, and the care it takes with the details that are not apparent. -
Doesn't sound like your "collection" if you're selling it, regardless of whether you solicited here. Further protests seem only to lessen any remaining credibility that you might have.

At least Pierre just talks. Emrick sounds like he thinks he's giving a speech, and getting extra points for pacing, style, cadence, number of different words used, regardless of meaning and fit. He also gets lost in the useless stuff he's saying, and forgets the game play.

I've had only 5 pairs of skates in my life. The first ones were bargain junk, the second were bottom-of-the-line Bauers, which weren't that bad. I really liked the third pair, Bauer Black Panthers, which I got about 1970. In 1975 I got Super Tacks, which didn't seem much different to me. A few years back I got One95s, and I like them the best. A big part of it is that they fit the best -- not that the others weren't a good fit. -
You'd need to know what the sun is like, what the kid's other behavior is, and how he responded when asked if he'd packed the stuff, among other things. Even with all that, I don't think I'd attempt to judge how parents choose to raise a kid. And if they've been consistent, the kid well knows what to expect. I was even wondering if he didn't pack the stuff deliberately.

That's why you have insurance -- because you have liability for certain occurrences on your property. Your liability here depends on fact, law, and circumstances. His friendship doesn't help him pay his medical expenses, so I wouldn't be surprised if he simply makes a claim with your insurer just to see if they think that you are liable for this. If he's not charging you for taking care of your driveway, he's been doing you a favor. If he is charging you, he should have business insurance. Either way, it's interesting that he would claim for an injury if it's due to a hazard that he was asked to remove. He doesn't have to sue, in order to file a claim with your insurer. The company will evaluate the claim, and make a decision. They may pay something just to avoid the costs of going to court. If they make a payment that satisfies him, he'll have no reason to sue. If it comes to a lawsuit, I'd expect that you and your insurer will be named as defendants. Your insurer has a duty to defend, so they'll secure a lawyer.
